When someone passes away, their home and other assets don’t automatically transfer to loved ones — they first go through a legal process called probate. It’s a word that often makes people nervous, but understanding how probate works can help you make smart decisions and avoid unnecessary stress during an already emotional time.


💡 What Is Probate?

Probate is the court-supervised process of validating a will (if there is one) and distributing the deceased person’s assets — like real estate, vehicles, and personal items — to heirs or beneficiaries.

If there’s no will, the court follows Arizona’s intestate laws, which determine who inherits property based on family relationships.

The main goals of probate are to:

  • Verify the will is legally valid

  • Identify and inventory all assets

  • Pay any remaining debts and taxes

  • Transfer ownership to rightful heirs


🏠 How Probate Affects Real Estate

If a home is part of the estate, it typically cannot be sold until probate is complete (unless a court grants special permission). This can delay sales — especially if multiple heirs are involved.

Here’s how a property may pass through probate:

  1. The executor (named in the will) or a court-appointed personal representative manages the process.

  2. An appraisal is done to determine fair market value.

  3. The home can be listed for sale once the court approves.

  4. Proceeds from the sale are used to pay debts, with the remainder distributed to heirs.

💬 Tip: Homes with a Transfer on Death Deed (TOD) or that are titled in a living trust often bypass probate entirely — saving time and costs.

In Arizona, probate typically takes six months to a year, depending on the complexity of the estate and whether disputes arise.

Simple estates can sometimes close in just a few months, but estates involving real property, multiple heirs, or missing documentation can take longer.


⚖️ How to Avoid or Simplify Probate

Here are a few strategies families use to simplify the process:

  • Create a living trust — transfers property outside of probate.

  • Add a beneficiary deed (TOD) to real estate.

  • Use joint tenancy with right of survivorship for co-owned homes.

  • Keep good records — clear titles, tax receipts, and will documents make everything smoother.
